1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Fig ("we," "us," or "our"), a marketing operating system and related services provided through our website and platform. By accessing or using Fig, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

If you are using Fig on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Fig is a marketing operating system (Marketing OS) that enables founder-led businesses to connect marketing tools, data, and workflows in a unified platform. Our services may include:

  • Marketing funnel and landing page creation
  • Integration with advertising platforms (e.g., Meta/Facebook, Google Ads)
  • Automation and workflow tools (including connections to Zapier, Make, and similar services)
  • AI-powered features such as persona generation and campaign optimization
  • Analytics, reporting, and data syncing across connected platforms
  • Other features we may add, modify, or discontinue from time to time

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

3. Account Registration and Responsibilities

To use certain features, you must create an account and provide accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your use complies with these Terms and applicable law

You must notify us immediately of any unauthorized access or use of your account.

4. Acceptable Use

You agree not to use Fig to:

  • Violate any applicable law, regulation, or third-party rights
  • Distribute malware, spam, or other harmful or deceptive content
  • Engage in deceptive advertising, fraud, or phish for personal information
  • Interfere with or disrupt our services, servers, or networks
  • Attempt to gain unauthorized access to our systems or other accounts
  • Scrape, copy, or reverse-engineer our platform except as permitted by law
  • Use our services for any illegal or harmful purpose

We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or our Acceptable Use Policy.

5. Payment and Billing

Certain features may require payment. By subscribing to a paid plan, you agree to:

  • Pay all fees at the applicable rates and intervals (e.g., monthly or annually)
  • Provide accurate billing information
  • Authorize us or our payment processor to charge your payment method

Fees are generally non-refundable unless otherwise stated or required by law. We may change fees with reasonable notice; continued use after a fee change constitutes acceptance. Unpaid amounts may result in suspension or termination of services.

6. Third-Party Integrations

Fig integrates with third-party platforms such as Facebook, Google, Zapier, and others. When you connect an integration:

  • You authorize us to access and use data from that platform as permitted by the integration and your consent
  • You are responsible for complying with that platform's terms of service and policies
  • We are not responsible for the availability, accuracy, or actions of third-party services
  • Disconnecting an integration may limit or disrupt related features

We do not endorse and are not liable for third-party services. Your use of integrations is at your own risk.

7. Intellectual Property

Fig, our brand, logo, and the design and content of our platform are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works of our services or content without our express permission.

You retain ownership of content you create or upload (e.g., landing pages, copy, campaigns). By using our services, you grant us a limited license to host, store, process, and display that content as necessary to provide the services.

We may use anonymized or aggregated data to improve our services and develop new features.

8. Disclaimer of Warranties

FIG IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fig and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of our services
  • Your violation of these Terms or applicable law
  • Your content or conduct
  • Any dispute between you and a third party related to your use of Fig

11. Termination

You may close your account at any time. We may suspend or terminate your access to Fig at any time, with or without cause or notice, including for violation of these Terms.

Upon termination, your right to use our services ceases. We may retain or delete your data in accordance with our Privacy Policy. Provisions that by their nature should survive termination (e.g., intellectual property, limitations of liability, indemnification) will survive.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

You agree to resolve any dispute on an individual basis and waive any right to participate in a class action or representative proceeding, except where prohibited by law.

13. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fig regarding the services.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also provide notice by email or through the platform.

Continued use of Fig after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using our services and may close your account.
